4 Legal References for SMBs and Informed Readers ? Small, Mobile ...

There are daily news developments regarding patent lawsuits, especially in the mobile arena. ?I?m not a lawyer? Nolo?s Encyclopedia of Everyday Law ? covers a variety of subjects for your business and home, and is a good first step when you begin your research.

Form Your Own Limited Liability Company ? Covers what an LLC is and compares it to other business entities. Member/manager responsibilities and tax issues are covered in detail. Takes you step by step through the process of forming your own LLC. Nolo has similar references available should you choose another entity type such as an S Corp, C Corp or Partnership.

Legal Guide to Web & Software Development ? covers areas such as licensing agreements, contracts and IP law (trademarks, copyrights, trade secrets and patents). Whether you are building your own web site or software, or contracting out development projects, this is a very useful guide.

Trademark: Legal Care for Your Business & Product Name ? from your company and product names to your logo, trademarks are something you?ll want to learn about. What exactly is the difference between TM, SM and ?, when can you use them, and what can be trademarked? You?ll find out here. You will also learn how to conduct a trademark search, which is helpful if you are marketing a new product or service. A registered trademark will provide the most protection. This guide also walks you through the process of registering your trademark with the U.S. Patent & Trademark Office.

Menard to fly Wis. workers in to staff ND store

(AP) ? Home improvement retailer Menard Inc. says it will hire workers from its home base in Wisconsin and fly them to North Dakota to staff a store in Minot, which is near the state's booming oil patch and has more jobs than takers.

The company said in a statement that it plans to hire 50 workers in Eau Claire, Wis., where it has its headquarters, and fly them weekly to Minot, which is also in the middle of an unprecedented building boom as it recovers from record flooding last year.

Menard, which has more than 200 stores in the Upper Midwest, said this would be the first time it has ferried in workers by airplane, but it believes jetting in employees for weeklong stints and housing them in hotels "is going to be a permanent solution for as far as we can see."

Minot is North Dakota's fourth-largest city and had been growing rapidly even before the flooding that swamped some 4,100 homes and displaced thousands of residents. Its population grew from 36,500 in 2000 to about 41,000 in 2010, U.S. Census data show. City officials say the present population is nearing 50,000.

That means there's strong demand for building materials. Minot store manager Phil Graef said business is the busiest in the five years he's headed the store, the only big-box building supply retailer in town.

"We were starting to stay even with the oil boom, and then the flood happened," Graef said. "Now, we're trying to get ahead of both of those."

Finding workers to keep up has been tough, he said.

"Everybody has a 'now-hiring' sign in their window," Graef said.

Businesses struggle to attract workers throughout North Dakota, which has some 22,000 more jobs than takers and the lowest unemployment rate in the nation, at 2.4 percent, Job Service North Dakota data show. The unemployment rate in Minot is 2.3 percent.

"It's going fast and furious here," Minot Mayor Curt Zimbelman said. "As it is, there is not a big enough labor force around here, and as it gets colder there is less of one."

The unemployment rate in Eau Claire is 6.3 percent, lower than the national rate of 7.9 percent in October. Mike Schatz, the city's economic development director, said its economy strong and there are job opportunities in the town of about 65,000.

"It's not like people can't find work here ? there are plenty of expansions going on," Schatz said.

But Menard spokesman Jeff Abbott said there was good interest when the company held a job fair in Eau Claire earlier this month to hire workers for its Minot store. Menard intends to train the workers at Wisconsin stores and send them to Minot "as soon as possible," he said.

Menard has offered a starting wage of $13 an hour at the Minot store, well above the federal minimum wage of $7.25 per hour, which prevails Wisconsin. It's also the minimum wage in North Dakota, but most jobs there pay more. A listing for a pizza delivery driver in Minot was advertised Thursday at $15 to $20 per hour, plus a $250 signing bonus.

Competition for the Menard jobs has been tough in Wisconsin.

Pam Weaver, of Eau Claire, said her husband, Gary, had his heart set on one of the positions with Menard in Minot but was told Thursday that he wouldn't be hired. No reason was given, she said.

"It's frustrating," Pam Weaver said. "He seemed disappointed."

Gary Weaver, who was laid off from his job as a telemarketer several weeks ago, was back at the unemployment office Thursday filling out job applications, said wife, a 55-year-old claims auditor for a health insurance company.

"Who would have thought that we'd be in our 50s and struggling?" Pam Weaver said. "We're not the only ones. We've had three different friends who have lost businesses in town in the last five years."

Zimbelman, the Minot mayor, and Menards store manager Graef said they hope some Wisconsin workers eventually decide to make Minot their permanent home instead of commuting more than 500 miles by air to get there.

But Eau Claire's Schatz has another idea.

"We would hope just the opposite," Schatz said. "We want them to bring that North Dakota money back to Eau Claire."

Fox News legal analyst Peter Johnson Jr. is terrified that society as we know will change ?forever? if Washington state moves forward with creating gender-neutral marriage certificates.

At a hearing on Wednesday, officials with the Washington State Department of Health said that soon after the law legalizing same sex marriages goes into effect on Dec. 6, marriage certificates would begin using the terms ?Spouse A? and ?Spouse B? instead of bride and groom.

?This is a sea change,? Johnson told Fox News host Steve Doocy on Thursday. ?This is a big anthropological change. This will change society in Washington and other states forever.?

?The issue becomes, in terms of gender neutrality, in terms of saying ?I?m a spouse, I?m not a husband or wife, I?m not a bride or groom, I?m someone about to be married? ? where does it go?? the legal analyst asked. ?Do we no longer say father and mother? Do we only say parent? Do we no longer say brother and sister? Do we say sibling? Do we no longer say widow or widower? What does it mean in terms of our relationships and how we view each other, people who choose to be engaged in heterosexual marriage??

?So you think what is happening in Washington state with this proposal is going to wind up rippling across the fabric if America?? Doocy wondered.

?It will!? Johnson warned. ?And it?s not about gay marriage, it?s about what will happen to heterosexual marriage and how those partners are defined and how those relationships go forward in our society.?

?It?s going to have a tremendous, tremendous impact,? he added. ?Watch this, see what happens. This is going to be a big, big, sea change in our society and how the smallest of our children understand relationships between parents, between husband and wife, between mother and father.?

Human-caused climate change signal emerges from the noise

ScienceDaily (Nov. 29, 2012) ? By comparing simulations from 20 different computer models to satellite observations, Lawrence Livermore climate scientists and colleagues from 16 other organizations have found that tropospheric and stratospheric temperature changes are clearly related to human activities.?

The team looked at geographical patterns of atmospheric temperature change over the period of satellite observations. The team's goal of the study was to determine whether previous findings of a "discernible human influence" on tropospheric and stratospheric temperature were sensitive to current uncertainties in climate models and satellite data.

The troposphere is the lowest portion of earth's atmosphere. The stratosphere sits just above the troposphere, between 6 and 30 miles above earth's surface.

The satellite temperature data sets were produced by three different research groups, and rely on measurements of the microwave emissions of oxygen molecules. Each group made different choices in processing these raw measurements, and in accounting for such complex effects as drifts in satellite orbits and in instrument calibrations.

The new climate model simulations analyzed by the team will form the scientific backbone of the upcoming 5th assessment of the Intergovernmental Panel on Climate Change, which is due out in 2014.

In both satellite observations and the computer model simulations of historical climate change, the lower stratosphere cools markedly over the past 33 years. This cooling is primarily a response to the human-caused depletion of stratospheric ozone. The observations and model simulations also show a common pattern of large-scale warming of the lower troposphere, with largest warming over the Arctic, and muted warming (or even cooling) over Antarctica. Tropospheric warming is mainly driven by human-caused increases in well-mixed greenhouse gases.

"It's very unlikely that purely natural causes can explain these distinctive patterns of temperature change," said Laboratory atmospheric scientist Benjamin Santer, who is lead author of the paper appearing in the Nov. 29 online edition of the journal, Proceedings of the National Academy of Sciences.

"No known mode of natural climate variability can cause sustained, global-scale warming of the troposphere and cooling of the lower stratosphere."

The team analyzed results from climate model simulations with specified historical changes in human and natural external factors, and from simulations with projected 21st century changes in greenhouse gases and anthropogenic aerosols. They also looked at simulations with no changes in external influences on climate, which provide information on the year-to-year and decade-to-decade "noise" of internal climate variability, arising from such natural phenomena as the El Nino/Southern Oscillation and the Pacific Decadal Oscillation.

The team used a standard "climate fingerprint" method to search for the model signal pattern (in response to human influences, the sun and volcanoes) in the satellite observations. The method quantifies the strength of the signal in observations, relative to the strength of the signal in natural climate noise.

Soul Train Awards 2012 winners list and air dates

Soul Train Awards 2012, held at Planet Hollywood Live in Las Vegas, was simulcast on BET and Centric on November 25 at 8p.m. ET/PT.? The audience was treated to the best in music entertainment.? Host Cedric the Entertainer, kept everyone laughing while stellar performances from artists including: Stevie Wonder, Charlie Wilson, New Edition, Ne-Yo, and 2 Chainz, encouraged people of all ages to dance and sing along to their memorable and popular songs.

Celebrities from music, film, sports and television such as Jamie Foxx, Stevie Wonder, Eddie Levert, Billy Crystal, Earvin ?Magic? Johnson, Melanie Fiona, Jody Watley, Doug E. Fresh, Tony Rock, Luke James, Estelle, Donny and Marie Osmond, Vampire Diaries star Kat Graham, and Tamar Braxton, joined Soul Train in celebrating some of the best musical contributions of 2012.? This year?s show honored New Edition with the Lifetime Achievement Award and paid tribute to late Soul Train founder, Don Cornelius.

The contributions Don Cornelius made to music changed the landscape of the industry. As a tribute, the Awards show featured video vignettes from old broadcasts, as well as moving words from his son, Tony Cornelius, and Soul Train standout, Jody Watley, who attributes much of her success to Cornelius and Soul Train.

New Edition, whose career has spanned 30 years, were honored with the Lifetime Achievement Award and followed their moving acceptance speech with a performance of their hits: ?Candy Girl,? ?Telephone Man,? and ?If It Isn?t Love.? Their performance reminded the audience why they fell in love with New Edition from the very beginning.

An always soul stirring performance by the ?8th Wonder of the World,? Stevie Wonder, turned into a massive celebration of President-Elect Barack Obama when his hit ?Superstition? was followed by a performance of??Signed, Sealed, Delivered, I?m Yours,? which was accompanied by projected photos of The President.

The competition was really tough this year with amazing artists and talent.?The 2012 Soul Train Awards Winners are:

This weekend brings us the return of the famous Leonid meteor shower, a meteor display that has brought great anticipation and excitement to night sky watchers around the world.

This will be a favorable year to look for the Leonid meteor shower because the moon will be only crescent and will have set in the west long before the constellation Leo begins to rise into the night sky. The Leonids appear to radiate out of Leo (hence their name), and with the moon out of the sky completely, viewing conditions could be perfect for stargazers with clear weather and dark skies.

The Leonid meteors are debris shed into space by the comet Tempel-Tuttle, which swings through the inner solar system at intervals of 33 years. With each visit the comet leaves behind a trail of dust in its wake. Much of the comet?s old dusty trails litter the mid-November part of Earth?s orbit and the Earth glides through this debris zone every year.?

Occasionally, Earth passes directly through an unusually concentrated dust trail, or filament, which can spark a meteor storm resulting in thousands of meteors per hour. That?s what happened in 1999, 2001 and 2002.? Since the Tempel-Tuttle comet passed the sun in 1998, it was in those years immediately following its passage that the Leonids put on their best show.?

But now, the comet and its dense trails of dust have all receded far outside Earth's orbit and back into the outer regions of the solar system. So odds are that there is little, if any chance of any unusual meteor activity. [Photographer Spots Early Leonid Meteors (Video)]

Peak times to see the Leonids

In the 2012 Observer?s Handbook of the Royal Astronomical Society of Canada, meteor experts Margaret Campbell-Brown and Peter Brown, indicate that this year?s peak activity should occur on Saturday morning, Nov. 17, at about 3 a.m. ET (0800 GMT). This is the moment when the Earth will be passing closest to the orbit of the long-departed comet, and when our planet seemingly is most likely to encounter some residual comet material. This time is highly favorable for North Americans, especially those in the eastern United States and eastern Canada. [Top 10 Leonid Meteor Shower Facts]

But while Leonid rates are unpredictable, it is unlikely that more than 10 to 20 meteors per hour may be seen this year.

Other meteor researchers, however, such as Jeremie Vaubaillon of France, and ?Mikhail Maslovof Russia have examined Leonid prospects for this year and also suggest watching for some meteor activity three days later, on Tuesday morning, Nov. 20.?

For example: Sometime around 1 a.m. EST (0600 GMT), the Earth may interact with material that was shed by comet Tempel-Tuttle back in the year 1400. But at best, only about 15 to20 Leonids per hour may be seen.?

(AP) ? The fire alarm: Waved off by managers. An exit door: Locked. The fire extinguishers: Not working and apparently "meant just to impress" inspectors and customers.

That is the picture survivors paint of the garment-factory fire Saturday that killed 112 people who were trapped inside or jumped to their deaths in desperation. For Bangladesh, where such factories commonly ignore safety as they rush to produce for retailers around the world, the tragedy was unusual only in scope: More than 200 people have died in garment-factory fires in the country since 2006.

About 15,000 Bangladeshi workers protested blocks from the gutted fire Monday, demanding justice for the victims and improved safety. Some 200 factories were closed for the day after the protest erupted in Savar, a suburb of Dhaka, the capital.

Protesters blocked a major highway, and some threw stones at factories and smashed vehicles, but there were no arrests and no clashes with police.

Maj. Mohammad Mahbub, fire department operations director, said investigators suspect that a short circuit caused the fire at the factory, which was making T-shirts and polo shirts.

But the Bangladesh Garment Manufacturers Association urged investigators not to rule out sabotage.

"Local and international conspirators are trying to destroy our garment industry," said Shafiul Islam Mohiuddin, president of the association. He provided no details.

Mahbub said it was not the fire itself but the lack of safety measures in the eight-story building that made the blaze so deadly.

"Had there been at least one emergency exit through outside the factory, the casualties would have been much lower," he said.

He said firefighters recovered at least 100 bodies from the factory, and 12 more people died at hospitals after jumping from the building to escape the fire.

The government was unable to identify many victims because they were burned beyond recognition; they were buried Monday in a grave outside Dhaka. The government announced that Tuesday will be a day of national mourning, with the national flag flying at half-mast in honor of the dead.

Local media reported that up to 124 people were killed, and that about 100 people injured in the fire were being treated in about a dozen hospitals. Many were hurt as they jumped to escape the flames.

Survivor Mohammad Ripu said Monday that he tried to run out of the building when the fire alarm rang but was stopped.

"Managers told us, 'Nothing happened. The fire alarm had just gone out of order. Go back to work,'" Ripu said. "But we quickly understood that there was a fire. As we again ran for the exit point we found it locked from outside, and it was too late."

Ripu said he jumped from a second-floor window and suffered minor injuries.

Another surviving worker, Yeamin, who uses only one name, said fire extinguishers in the factory didn't work, "So these were meant just to impress the buyers or authority."

TV footage showed a team of investigators finding some unused fire extinguishers inside the factory.

The garment-factory fire was Bangladesh's deadliest in recent memory, but there have been several major factory fires in recent years, including one that killed 63 people in 2006 in southern Chittagong town.

Labor leaders hope outrage over the latest disaster will prompt change. Tahmina Rahman, general secretary of the Bangladesh Garment Workers Federation, says the group wants the government to work harder to punish factories for safety lapses.

"The owners go unpunished and so they don't care about installing enough security facilities," she said. "The owners should be held responsible and sent to jail."

The factory in Saturday's blaze is owned by Tazreen Fashions Ltd., a subsidiary of the Tuba Group that has produced clothing for Wal-Mart, at least in the past. Neither Tazreen nor Tuba Group officials could be reached for comment.

The Tuba Group is a major Bangladeshi garment exporter whose clients include Wal-Mart, Carrefour and IKEA, according to its website. Its factories export garments to the U.S., Germany, France, Italy and the Netherlands, among other countries. The Tazreen factory, which opened in 2009 and employed about 1,700 people, made polo shirts, fleece jackets and T-shirts.

Tazreen was given a "high risk" safety rating after a May 16, 2011, audit conducted by an "ethical sourcing" assessor for Wal-Mart, according to a document posted on the Tuba Group's website. It did not specify what led to the rating.

Wal-Mart spokesman Kevin Gardner said online documents indicating an orange or "high risk" assessment after the May 2011 inspection and a yellow or "medium risk" report after an inspection in August 2011 appeared to pertain to the factory. The August 2011 letter said Wal-Mart would conduct another inspection within one year.

Gardner said it was not clear if that inspection had been conducted or whether the factory was still making products for Wal-Mart. If a factory is rated "orange" three times in two years, Wal-Mart won't place any orders for one year. The May 2011 report was the first orange rating for the factory.

"Our thoughts are with the families of the victims of this tragedy," the retailer said in a statement. "While we are trying to determine if the factory has a current relationship with Wal-Mart or one of our suppliers, fire safety is a critically important area of Wal-Mart's factory audit program and we have been working across the apparel industry to improve fire safety education and training in Bangladesh."

In its 2012 Global Responsibility report, Wal-Mart said it ceased working with 49 factories in Bangladesh in 2011 because of fire safety issues, and was working with its supplier factories to phase out production from buildings deemed high risk.

Bangladesh has some 4,000 garment factories, many without proper safety measures. The country annually earns about $20 billion from exports of garment products, mainly to the U.S. and Europe.

The Bangladesh Garment Manufacturers and Exporters Association said it would stand by the victims' families and offered 100,000 takas ($1,250) to each of the families of the dead. Tazreen's owner was meeting with representatives of the group Monday afternoon.

"We will discuss what other things we can do for the families of the dead," The association's acting president, Siddiqur Rahman, said Sunday night on Rtv, a private television station. "We are worried about what has happened. We hope to discuss everything in detail in that meeting."

Another fire broke out Monday in a 12-story building housing four garment factories, but the fire department said it was quickly doused and there were no casualties.

Marriage, Trail Relationships, and the AT


i wouldn't "test" a marriage with anything, much less a thru hike... paces vary, physical abilities vary. my ex wife liked to hike, but hated to backpack, the few times she did go with me i ended up carrying the bulk of the weight (as any good husband will)

my regular hiking buddy is 6'6" tall, his fiance is 5'1"... there is no way they can naturally hike at the same pace, one of them is always going to be outside their comfort zone. we took her out for her first backpacking trip, she did great. she dehydrated food, cooked little loaves of banana bread with protein powder, totally got into handing them out as trail magic. she took to the social aspects of the trail more than i ever have. but we stopped far more than i usually do. i never complained (gotta protect my best man status) but looking forward to future hikes, i see myself hiking ahead of them. no wife, or husband, wants to be left behind.

i gave a ride this spring to three thru hikers, from unicoi into helen. a couple, and his best friend. she was into it, the best friend was into it, but the boyfriend was WAY out of his depth. it was obvious to me he didn't really want to be there. he was a cool guy, i bought them all a beer, but afterwards joked with my friends she should drop him and hike on with his best friend. does that reflect on their relationship at all? no, i don't think so. i wonder what happened to them, the realist in me thinks he probably dropped... did she drop with him? who knows. if you're on a thru hike with your wife or husband, and they need to drop, for whatever reason.... will you hike on, or be a good spouse? its not even a close call, you're gonna drop.

i wont be starting my thru hike attempt with a partner. i'll just be one of the masses. i'm sure i'll fall in with others that share my pace, i'm sure that over the course of the entire trail my pace will change, as will the company around me. i wouldn't want to put that burden on a relationship.

Fighting Sandy debris-removal crooks: There's an app for that

NEW YORK (Reuters) - A devastating storm like Sandy can bring out the crooks - and not just opportunistic looters and burglars.

Officials dealing with the destruction in the U.S. Northeast say one of their biggest headaches is debris-removal fraud committed by greedy contractors who inflate their share of the millions in cleanup funds doled out by federal agencies.

But new digital technology created by private companies and municipalities in the wake of Hurricanes Katrina and Irene is making it much easier to stop firms from overcharging by claiming they have trucked away more wreckage than they have.

The new software combats fraud and also streamlines the vexing municipal task of documenting every last dumpster of debris or broken tree branch to prove to Federal Emergency Management Agency auditors that the money was properly spent.

Ray Iovino learned his lesson after 2011's Hurricane Irene, which caused nearly $16 billion in economic damage across eight northeastern states of the U.S.

As assistant director of the bureau of equipment and inventory for Long Island's Nassau County, Iovino remembered all too well the messy months of paperwork that consumed his office after Hurricane Irene felled nearly 2,500 trees in his area.

"The first thing they asked for were the pictures of every tree that went down in the storm," Iovino said, in reference to FEMA. County officials, unfamiliar with federal regulations, had simply written down the locations of the trees, which wasn't good enough.

"FEMA said they'd have to go out and look at every single location," Iovino said. "It was a nightmare." FEMA also "wanted to know which trucks trucked what debris where and when and how," he said.

FRAUD VICTIM

As Superstorm Sandy raced up the U.S. eastern seaboard in late October, Iovino began researching a more efficient system to document the massive damage he expected, and found DebrisTech, a Mississippi debris-removal company whose chief executive was himself a victim of fraud after Katrina devastated the U.S. Gulf Coast region in 2005.

At that time, DebrisTech CEO Brooks Wallace was a partner in a civil engineering firm that had won a $200 million contract to remove Katrina wreckage from six Mississippi counties. The firm was using a paper ticketing system to track the trucks hauling away debris, a standard industry practice.

It was a huge job and Wallace's company sub-contracted some of the work out to other firms, including Florida-based J.A.K. DC & ER, whose owner saw an opportunity, according to federal prosecutors.

J.A.K. owner Allan Kitto peeled off the stickers Wallace's firm had affixed to his trucks and sent the same trucks back to be stickered again, inflating the number of trucks he appeared to be using and the number of debris hauls he was making.

At night, Wallace said, Kitto would "sneak into my office at two or three in the morning and slide phony paper tickets into the stack of real tickets." Each ticket represented a truck full of debris that Kitto's trucks allegedly hauled away. By the time he was caught, Kitto had submitted more than $700,000 worth of fake paper tickets, according to federal prosecutors.

Wallace became aware of the scam and contacted the Federal Bureau of Investigation. In 2006, Kitto and two others were indicted on federal charges of conspiring to defraud the government. In 2007, Kitto was convicted and sentenced to 25 months in prison.

BARCODE SCANNERS

Wallace, an engineer, began thinking about how to avoid a repeat of that hurricane cleanup experience. He spent $60,000 developing custom software to digitally track debris trucks with barcode scanners, digital photos and global positioning systems. That data would then be wirelessly uploaded to a central database.

DebrisTech, one of a handful of private companies using the digital tracking software, leases out iPads loaded with its software to municipalities for $12 per device per day. Nassau County leased about 100 of DebrisTech's 120 devices, Iovino said.

The software also maps the locations of downed or removed trees using GPS coordinates. Iovino has plotted the GPS coordinates of each of the county's 2,641 downed trees - a figure Iovino expects to rise to 5,000 by the time the cleanup is finished - onto a digital map of Nassau in the county's emergency operations center.

"It's amazing what a difference this software has made," he said. "Now when anything is picked up on Nassau County property, we know the size of the truck, the percentage the truck is full, we've got a picture of the debris in the truck, which transfer site it went to, and where it is right now.

"When FEMA comes back this time, I'm going to hand them a CD with every imaginable piece of documentation on it. The amount of man hours that we've saved is incredible, plus the amount of man hours that FEMA would have to put in to go back and document all the downed trees and debris removal. It's incredibly efficient."

Industry experts expect technology like DebrisTech's to have a profound effect on post-disaster cleanup.

"I've been in debris-removal projects all over the country - Florida, California, Texas, Virginia - huge hurricanes, wildfires, floods,'' said Russ Towndrow, a former Mississippi Emergency Management Agency official who has used the DebrisTech software. "This real time data is a game-changer," he said.

A FEMA investigator involved in federal audits of cleanup funds concurred.

"Debris removal can be a sizeable percentage of overall FEMA funding, so the better shape the documentation is in, the more it will ease the entire process," the investigator said.

FRAUD PREVALENT

Debris-removal fraud is widespread after major natural disasters, according to federal and state law enforcement officials.

"You can count on it every time," said a senior federal prosecutor who investigates post disaster fraud. "It's one of the first things we look for," said the official, who requested anonymity in return for discussing ongoing investigations.

Dishonest contractors will "do just about anything you could imagine - they'll put water in trucks to weigh them down, they'll put blocks underneath the debris to make the trucks look full. Or the guy at the gate will give a driver a new ticket for driving through with the same load."

Digital debris-removal technology is also being tested by municipalities like New York City. Programmers working with the city's Parks Department recently completed work on software to replace an arduous and time-consuming paper ticketing system, said Jeremy Barrick, the Parks Department's deputy chief of forestry.

"We were using paper ticketing after Irene, and we sat down afterwards to talk about how we could track debris removal more efficiently," Barrick said, which led to the development of proprietary software known among city officials as "Storm Mobile."

The software interfaces with the city's non-emergency 311 call center, which residents can use to report downed trees.

"Every time the city logs a service request for a downed tree removal, our inspectors can see it in virtually real time."

After Irene, Barrick said, New York City logged 10,000 calls about downed trees, compared with 26,000 to date after Sandy.

"The Irene tree tracking took months," Barrick said. "We had big spreadsheet parties on overnight shifts, where we'd gather all these faxed-in paper lists of downed trees, transpose them over to a written database, and then upload them into an electronic system.

"With the Storm Mobile app, within 20 days we had a pretty clear picture of every downed tree in New York City," he said.

"With this electronic system," Barrick said in reference to the lack of paperwork, "we've actually saved a lot of trees."
